These Terms & Conditions govern all sales of artworks through the Alistair Grant Estate website. All enquiries should be directed to the Estate before any purchase is confirmed.

The Estate offers original works of art for sale to collectors and institutions worldwide.

Article 2

Description of Artworks

Each artwork is presented with a description including, where applicable: title, medium, dimensions, year of creation, framing information, and edition number for prints.

Photographs are provided for illustrative purposes only. Minor variations in colour or appearance may occur due to digital display settings. All dimensions are approximate.

Each original artwork is unique unless expressly stated otherwise. All works are sold subject to availability.

Article 3

Prices

Prices are provided on request in Euros (€). Shipping costs, insurance, customs duties, import taxes and any local charges applicable in the destination country are the responsibility of the buyer and will be indicated prior to confirmation of sale.

For deliveries outside the European Union, local taxes and customs duties may be payable upon importation.

Article 4

Orders & Payment

All sales are initiated through the contact form or by email to alistairgrant.estate@gmail.com. The sales contract is formed upon receipt of full payment and written confirmation from the Estate.

Payment is accepted by bank transfer. Full payment is required before shipment. Ownership of the artwork transfers to the buyer upon full payment.

The Estate reserves the right to refuse or cancel any order in cases of pricing errors, unavailability, or suspected fraud. In such cases, any amounts paid shall be refunded in full.

Article 5

Authenticity & Certificate

The Estate guarantees that all artworks offered for sale are authentic works by Alistair Grant (1925–1997).

Each original artwork shall be accompanied by a Certificate of Authenticity containing: artist's name, title, medium, dimensions, date, and signature of the Estate representative.

Condition reports and additional photography are available on request prior to purchase.

Article 6

Shipping & Delivery

Works are shipped worldwide. All works are professionally packed and insured in transit. Delivery times are estimates only and are not guaranteed.

Risk of loss or damage transfers to the buyer upon physical delivery. The Estate shall not be liable for delays caused by transport carriers, customs authorities, or force majeure events.

The buyer must provide an accurate delivery address. Additional costs arising from incorrect information may be charged to the buyer.

Article 7

Inspection Upon Receipt

The buyer must inspect the artwork immediately upon delivery. Any visible damage must be noted on the carrier's delivery document and reported to the Estate within 48 hours of delivery, with photographs and supporting evidence.

Failure to comply with these requirements may affect insurance claims.

Article 8

Right of Withdrawal & Returns

For consumers residing within the European Union, the statutory right of withdrawal under Directive 2011/83/EU applies. The buyer has 14 days from receipt to notify the Estate of the decision to withdraw, and a further 14 days to return the artwork.

The artwork must be returned in its original condition, with all documentation, the Certificate of Authenticity, and in its original or equivalent protective packaging. Return shipping costs are the responsibility of the buyer.

Commissioned or personalised artworks are exempt from the right of withdrawal. Refunds will be processed within 14 days after receipt and inspection of the returned artwork.

Article 9

Intellectual Property

The purchase of a physical artwork does not transfer any copyright or intellectual property rights. All copyrights and reproduction rights remain the exclusive property of the Grant Estate.

Without prior written consent, the buyer may not reproduce, publish, distribute, or commercially exploit images of the artwork. Any permitted use shall comply with applicable copyright laws.

Where applicable under French and European law, resale royalty rights (droit de suite) shall remain governed by applicable legislation.

Article 10

Limitation of Liability

The Estate's total liability shall not exceed the purchase price paid for the artwork, except where mandatory law provides otherwise. The Estate shall not be liable for indirect, incidental, or consequential damages.

Article 11

Data Protection

Personal data collected during the ordering process is processed in accordance with the General Data Protection Regulation (GDPR) and applicable French data protection law. Information is used solely for order processing, accounting, and legal compliance.

Buyers may exercise their rights of access, rectification, erasure, and portability by contacting the Estate at alistairgrant.estate@gmail.com.

Article 12

Governing Law & Dispute Resolution

These Terms & Conditions are governed by French law. For consumers residing in the European Union, mandatory consumer protection provisions of the country of residence shall remain applicable.

In the event of a dispute, the parties shall first attempt to resolve the matter amicably. EU consumers may also use the European Online Dispute Resolution platform.

Any unresolved dispute shall be submitted to the competent courts of the Tribunal judiciaire de Dieppe (76204).
